When discovered, these conditions will be addressed through a written change order, which may affect the project price and schedule.
5. Third-Party Materials and Manufacturer Warranties
Many products, materials, fixtures, and appliances installed in a project are manufactured by third parties and carry their own manufacturer warranties. Those warranties pass through to the Client, and any claim regarding a product defect must be made under the applicable manufacturer warranty. Valor Builder does not manufacture these products and disclaims responsibility for product defects, recalls, or manufacturer warranty terms. We will reasonably assist the Client in pursuing manufacturer warranty claims.
6. Limitation of Liability
To the fullest extent permitted by law, Valor Builder, its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the Site or our services. Our total liability for any claim shall not exceed the amount paid by the Client for the specific services giving rise to the claim. Nothing in this section limits liability that cannot be limited under Virginia law.
7. Indemnification
You agree to indemnify, defend, and hold harmless Valor Builder and its owners, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney’s fees) arising out of your breach of these disclaimers or any applicable agreement, your misuse of the Site, your violation of any law, or your provision of inaccurate property or project information.
